Question – What is the deadline (or last date) to apply for H1B Visa 2011?

Answer – There is no deadline to apply for H1B Visa FY 2011. As long as H1B Visa Cap is available, employer can file for H1B Visa petition.

Since, H1 Cap ran out within first 1 week in previous years, most of them who cannot find H1B Visa sponsors think there is deadline to file H1B visa 2011 petition.

H1B Visa Deadline

H1B Visa Fiscal year starts on October 1 of each year and runs till September 30 of next year. For example H1B Visa FY 2011 starts on October 1, 2010 and runs till September 30, 2011.

  • H1B General Cap – 65,000 (per year)
  • H1B Masters Cap – 20,000 (per year)

USCIS would accept H1B  petitions for Fiscal Year 6 months in advance, which is April 1 of that year. For FY 2011, H1 petitions will be accepted from April 1, 2010.

USCIS will accept petitions until quota is available. There is no deadline (specific) till which application would be accepted. Universities have admission deadlines and don’t confuse that with USCIS H1B visa deadline.

If application is submitted on April 1, 2010 and USCIS would approve the H1B Visa with starting date of October 1, 2010. Yes, you have to wait for 6 months before you can start working on H1.

But, after October, if H1 cap is still available, one can start working as soon as H1 is approved.

Hope this gives an idea about why there is no H1B Visa 2011 deadline.
