  2. Hi,

I’m currently on OPT which will expire in December 2012. My company is willing to pursue my H1B, they’ve got my paperwork and everything’s been sent to a lawyer. But for some reason this guy is not filing…I’m afraid that I won’t fall within the cap, given that already 42,000 petitions have been received as of 5/18/12. What happens if I miss the cap? Will I be able to stay in the country once my OPT expires? Is so would I be able to work or I would have to wait for my company to file for my H1B again and start working once I get approval?
Thank you, I appreciate your opinions.

      1. I have already applied for the 17 month extension and that’s the one expiring in December 2012. That is why I feel like my hands are completely tied…

  3. Hi
HSB is giving good suggestions.I am in OPT for the last 4 months and will expire by JAN 2013.My employer is filing H1 in this month i.e april 2012.Already 11000 filled up by 20/4/2012.My chances of getting H1 within 20000 is not known. My question is,if I cannot get it during this year(I still have my OPT upto Jan2013) Can I apply for OPT extention for next 17 months under STEM before expiry of original OPT or not? OR will this not be allowed as I applied for H1?(I will apply for OPT EXtn after ensuring that H1 quota of 20000 is over in 2012)Please advice

    1. Yeah..Its being difficult..
if you are in India and what to go for H-1 from ther..we can say there are no consultants who can sponsor you..
Even if you are in US with H-4 Its difficult for you to find a sponsor!!
But to transfer from OPT to H-1 would be very easy!!
