H-1B Cap Count Update – Aug. 19, 2009

As of August 14, 2009, approximately 45,000 H-1B cap-subject visa petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed to date.

The USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B visa petitions had been received to reach the statutory limits.

This takes into account the fact that some of these petitions may be either denied, revoked, or withdrawn.

Previous Update – H-1B Visa 2010 Cap Count update was made on Aug. 7, 2009.

In the last 12 days, it looks like the USCIS had received around 100 applications under the General H-1B Quota.

  1. h1b visa have additional quota for masters or higher degree from USA

    it requires

    only masters or higher degree certificate

    or

    it also requires total 150 credits that is 120 credits of bachelor degree + at least 30 credits of USA master or higher degree

    or

    3 years ug bachelor degree with 90 credits

    and

    1 yr pg masters or higher degree from USA with 30 credits

    total being 120 credits will also eligible for

    additional 20000 h1b quota for masters or higher degree from USA

  2. Good daY. I have an H1b Visa Issued last Aug. 2008. Unfortunately i was not able to use because of one big family problem most concern on finances and health. Now that its almost Ok I still have the H1b visa ok until 2011 of september. My question is can I still go to US and use the same H1B Visa safely? Anyone please help.

    I need your help if anyone is in the same situation. I sent my application thru Premium Processing on August 24th, it arrived August 25th (via Fedex). I haven’t got my Receipt Notice Yet!! I am freaked out because It’s already one week but not heard from USCIS. Is this still Ok and I should receive it soon? How long does it take to get a receipt from them? should it take 15 days from the receipt notice date? Please help!!

  6. I applied for H1b visa through an employer. Got receipt number by Apr 23. But Still it says case received and pending.
    Now I wish to apply again through another employer.

    My doubt is :
    How long will USCIS continue to accept H1B applications for 2010?
    Will they stop accepting after OCT 1st or do they still accept until the quota finishes?

  10. I worked in US before under H1B visa but left and work in another country. A fried told me that I could still use my previous H1B visa for recapturing (H1B visa stated that it which will expire on May 2010) as long as I have employer who sponsored me and therefore be no longer subject to H1B cap.

    Is this true? Or should i need to be subject to H1B cap every time I left US and work in another country?

  12. Thanks for the great blog and very helpful information. I have a quick questions.

    I am in US now. After I submitted the H1B application, before I get any result, I need to leave US for 2 week. Because I still have a valid J visa, I will be able to get back to US with my J visa. Is this Ok for my H1B application? Are the officer going to check my status, if they find I am out of US, they will deny my current application?

    1. AS general rule if you travel outside US when COS in progress, it will not be approved. So, talk to your Immigration attorney before you travel.
